Litigation risk: Prof. Lahav consults with financial professionals to help them evaluate litigation risk exposure, particularly in toxic tort, pharmaceutical, and medical device litigation in state and federal courts, providing unbiased evaluations of the exposure firms face in large-scale, multi-district litigation. She is able to explain the legal landscape clearly to non-lawyers and to preview the types of risks resulting from litigation, without getting bogged down in unnecessary detail that can cloud the overall evaluation. (Although she is always happy to delve more deeply into any issue as needed). Her years of study of mass torts enable her to set litigation in context and to provide analogies for how a case might proceed based on past cases. In addition, she follows cutting edge, emerging changes to practice that may increase or decrease exposure.
Strategic analysis: Prof. Lahav has assisted law firms in making strategic plans for large scale litigation proceeding in multiple forums and has advised firms new to class action practice on class certification and ethics issues.
